The notion of dependent child

The role of head of the household is recognised as the person effectively and routinely taking responsibility for the child's education and welfare. To be considered as "dependant", as determined by Monegasque legislation, the child must satisfy the conditions below.

Condition of residence
The child must reside under the roof of the head of the household, unless otherwise justified:

  • for health reasons,
  • for educational reasons,
  • due to an institutional placement, made in their interest.

Age requirement
The child must be aged under 21.

  • from age 6 to 16, they must attend compulsory education or justify the impossibility of complying with this obligation for health reasons.
  • over the age of 16, they must
    • continue in secondary, higher or vocational education,
      or
    • have an apprenticeship contract and be receiving a monthly remuneration that is below than the national minimum wage after age deductions,
      or
    • be looking for their first salaried job and consequently, be registered with the Employment Service (in this case, Family Benefits can only be paid between the 16th and 17th birthday),
      or
    • be in a situation where it has been medically recognised that they are unable to study or pursue an occupational activity.

When a child works in a salaried activity while studying, they cease to be a dependent child if the income they receive from this activity is on average greater than€1,008.56 on October 1, 2023
