About the Protection of Personal Data
- Who are we and who is involved in protecting personal data?
- The name "Casses Sociales de Monaco" brings together five private law organisations charged with a public interest mission:
- la Caisse de Compensation des Services Sociaux (CCSS),
- la Caisse Autonome des Retraites (CAR),
- la Caisse Monégasque de Retraite Complémentaire (CMRC),
- la Caisse d’Assurance Maladie, Accident et Maternité des Travailleurs Indépendants (CAMTI),
- la Caisse Autonome des Retraites des Travailleurs Indépendants (CARTI).
- These organisations are established in the Principality of Monaco: 11, rue Louis Notari.
- To fulfil their missions, they have computer resources and carry out processing of personal data.
- Each organisation in its own right has the status of "Data Controller" within the meaning of Law 1.565 on the protection of personal data.
- This notice details the commitments undertaken by each organisation making up "Caisses Sociales de Monaco" regarding the protection of personal data.
- This notice concerns you if you are in of one of the following categories of people whose data is collected and/or processed by "Caisses Sociales de Monaco" :

- The aforementioned organisations process your personal data to carry out the missions conferred on them by laws, regulatory texts and contractual commitments, including:
- the registration of employers, self-employed workers, employees and beneficiaries,
- the processing of salary declarations,
- the collection of social security contributions,
- the management of medical services,
- the management of family benefits,
- the management of basic and supplementary pension benefits,
- the management of social action,
- real estate management.
- All data collected by our organisations may be used for the purposes of controlling the right to benefits.
- The aforementioned organisations process your personal data to carry out the missions conferred on them by laws, regulatory texts and contractual commitments, including:
- What is the basis for the collection and use of your personal data?
- The collection and use of your data by “Caisses Sociales de Monaco” is based on:
- compliance with the legal obligations to which the five aforementioned organisations are subject,
- the existence of a reason of public interest,
- and in some cases, the realisation of a legitimate interest of said organisations.
- The founding texts of the five organisations are as follows:
- Decree-Law n°397 of 27 September 1944 creating a social services compensation fund (CCSS),
- Law n°455 of 27 June 1947 on employee pensions (CAR),
- Law n°1.544 of 20 April 2023 establishing la Caisse Monégasque de Retraite Complémentaire (CMRC),
- Law n°1.048 of 28 July 1982 establishing a social benefits scheme for the self-employed (CAMTI),
- Law n°1.493 of 8 July 2020 establishing a family benefit scheme for the self-employed (CAMTI),
- Law n°644 of 17 January 1958 on the retirement of self-employed workers (CARTI).
- Furthermore, CCSS, CAR and CMRC have Rules of Procedure and other regulatory texts detailing the missions of the five organisations.
- Two bilateral social security agreements - one with France and the other with Italy - provide for administrative mutual assistance and justify the exchange of certain data.
- The collection and use of your data by “Caisses Sociales de Monaco” is based on:
- What types of personal data are collected?
- “Caisses Sociales de Monaco” ensure that the data collected or recorded, directly from you or indirectly via partner public organisations, is adequate, relevant and limited to what is necessary with regard to the purposes for which it is processed.
- The following categories of data are collected and processed by the five organisations so that they can carry out the missions conferred on them by law and regulations.
- IMPORTANT: All data collected by our organisations may be used for the purpose of checking the right to benefits.
- How is your personal data protected?
- “Caisses Sociales de Monaco” takes every precaution to maintain the security and confidentiality of your personal data.
- Data is processed by authorised personnel who must comply with rules of procedure and processes in order to protect them.
- Furthermore, “Caisses Sociales de Monaco” implements adequate technical and organisational measures to protect your personal data against destruction, loss, alteration, misuse, unauthorised disclosure or access, accidental or illegal and against any other form of unlawful processing.
- How long will your data be stored?
- “Caisses Sociales de Monaco” only retains your data for the time necessary for the purposes for which they were collected or to comply with legal and regulatory requirements.
- In addition, data retained for statistical purposes is subject to an anonymisation procedure.
- Who has access to your personal data?
- As indicated above, personal data is processed by authorised personnel of "Caisses Sociales de Monaco".
- This data may also be transferred, upon request, to competent persons and authorities in the context of validly formed judicial or administrative proceedings, requests for mutual assistance provided for by Bilateral Conventions or in order to comply with other legal, regulatory or contractual obligations.

- What are your rights?
- In accordance with legal and regulatory provisions, you can exercise the following rights with regard to your personal data:
- Right of Access
You have the right to request what personal data about you is held by "Caisses Sociales de Monaco". You can also access data about you.
- Right of Correction
You can request, at any time, the correction of personal data concerning you if you find that it is incomplete or incorrect.
We must emphasise the importance of providing us with accurate and up-to-date information, as well as the need to notify us without delay of any significant changes about you.
- Right to Limitation of Processing
In certain specific cases (e.g.: a dispute about the accuracy of data), you can request the limitation of the processing of your personal data.
- Right to Object to Processing
You can object to the processing of your personal data in certain specific cases. Our organisations will no longer process your data, unless they can show that there are legitimate and compelling reasons for the processing which have precedence over your interests.
- Right to Transfer
You have the right to obtain the personal data you have provided.
- Right of Access
- IMPORTANT: Right to Erase Data - You cannot exercise this right with regard to processing for the performance of a task of public interest by a legal entity under private law.
